Automatically registered to waiting list?

Hi,
during mass testing yeserday we got once situation where two persons tried to get the last available ticket for an event. They both entered their information, counted down loud and pressed on the confirm button. One of them got the last ticket, the other one a confirmation for the waiting list. Is this as designed, that the waiting list is automatically used or do they tell me something which is not even possible?

When they click on Process Registration button, if during that time there is not available place left, they will be added to waiting list automatically if waiting list is enabled. If waiting list is not enabled, the person come late will be rejected

Ok. Can I somehow prohibit this? Waiting List is used, but it should work only if someone uses the dedicated button for the waiting list.,..

I was able to deactivate it in the register.php, but not with an overwrite...so if there is another possiblity, I would feel better...
