Terms and Conditions article settings not working

Hi I am running EB 3.2.1 and j!385
I set T&C's to Yes in config and set a T & C joomla article1
In an individual event I have article2 set as a T&C.
However article1 ( the default) keeps popping up - is this a bug?
I tried clearing caches and have no overrides.

UPDATE - updated to EB3.3.1 and j!386
The T and C settings are seem to be ignored by the event even setting them to "no" still shows the t & c checkbox
