terms and conditions

I had to tick the special 'terms and conditions' box in configuration to get Terms and Conditions to 'popup', but it is no longer a pop up, it is a completely separate 'tab' in the browser. This is likely to confuse users who are in the process of buying a ticket, and suddenly find themselves on a completely new browser tab, and wondering where the booking form disappeared to?
Is there any way of getting the 'terms and conditions' article to actually pop up?

At the moment, the extension use Joomla core Modal popup to show the terms and conditions article in the popup. However, sometime, this modal popup doesn't work and that's the reason I have the config option to solve the the problem (just a temp solution).
A good solution would be install a third party plugin called Modalizer www.nonumber.nl/extensions/modalizer . The only limitation is that plugin will only works if your server is running PHP 5.3. Could you please give it a try ?

I have the same problem, but in my case the config option does not fix it, the "Terms & Conditions" always go to a full size new tab. I have looked at the replacement to Modalizer, called Modals, but cannot figure out where to put the code to force the link to open in a popup.
Help.
