As a business owner, I would never want to tell a customer they cant order, this gives them the opportunity to buy somewhere else. That said I dont know what you do, or the products you sell, so I cant speak for you.
Wouldnt a better solution be to add business hours to the "Translation" page for any of the checkout process pages so that it listed your business hours and informed customers during checkout that any orders placed after 10 PM would be processed the next day?
We do this on our shipping method screen (step 5 of the checkout process) so the customer knows details that we need them to know. This happens during the checkout process though, so they get informed at checkout. You could do the same on any of the steps of the checkout process to inform your customers, but at the same time gain the sale. See the screenshot below...
